View Full Version : [Question] Another NIP question

i have just joined the site and have a question regarding a nip that i received.
i was surprised to receive a nip recorded delivery as i had no knowledge of breaking any laws..it said i had been involved in a collision while in a car park.the alleged offences was failing to stop,failling to report and driving without due care and attention.
although i was in the car park at the time stated on the nip i have absolutely no knowledge of being in contact with any other vehicle,so when the shock had worn off i went outside and examined every inch of my car but couldn't find a mark or a single scratch anywhere.i filled in the nip and hand delivered it to the police station quoted on the return address.i asked the lady on the desk if i would receive a follow up letter explaining what i had supposed to have done (because i hadn't done anything) after going for a word with someone she gave me the name and contact phone number of the police officer dealing with the case.
i rang him and it appeared someone had apparently seen me come into contact with another vehicle and he had left my car details and his contact number under the wipers of the alleged damaged car..hence my reason for receiving the intended prosecution.
the officer told me the damage was very minor and was more of a slight scuff on the paintwork..i told the officer that i didn't do it and asked if photo's of my car could be taken as proof of no damage and no evidence of collision on my car.he said if i wanted to come down to the station he would take pics for me,which i did.
after taking the pics and having a good look around my car he commented on what good condition it was in and said that the police would not be taking the matter any further,and i would receive an official letter from him to that effect.
i have never had any dealings with the police before and have held a clean license for 37 years with no claims,but i was obviosly nervous because of the seriousness of the charges..but i have to say from my first dealings with this officer over the phone to actually meeting and talking with him..i found him to be very easy to talk to,courtious. professional and very helpful,and not at all like some of the stories you read.
anyway after all that my question is...
the police are not proceding with the charges,but having read that the cps is a totally different body from the police will i still be prosecuted by the cps for the stated offences,it may seem a silly question for people in the know but i don't have a clue,so i am worrying about that now.

In this case the 'Charging decision' lies with the Police and the CPS will not push for a trial.

Welcome to 5-0 archie, now you are here, stay around and get involved.. go to front office Id section and say HI. You will be amazed how the site opens up to you after you have posted a number of times. There is more to see and get involved in.

It is of course entirely possible that 2 cars can collide and one sustain damage and the other nothing at all. Wheels / tyres often cause damage that you cant later find on the offending wheel / tyre.

car park bumps are very common and many go un recorded, its a real pain when you discover damage like that and nobody to claim off. Also the damage can be that slight that you would not claim on your insurance as the excess will be greater than the cost of repair.

It is always easy to have this sort of case alleged and often very difficult to prove or dissprove. Evidence is generally lacking..... (damage to both vehicles)

To let your mind rest - from my dealings - the police decide if it's sufficient to pass to the information to the CPS - the CPS decide if it's sufficient to prosecute.

Your friendly officer says it's going to be OK for you - the CPS should not hound you. ;)
