If someone or yourself admits guilt at the scene of athe acidient does it void the policy as i remeber hearing this a while back.

Not in the slightest. What it does do is give you more leverage on the claim against them.

Helps if you have a witness to them saying it's their fault, of course....

The thing is to be able to prove they admitted the accident was their fault. Bes thing to do is to get them to sign something admitting that they caused the accident & that they are signing the admissoin of their own free will. If possible get someone to witness this & sign the statement as well.

Funny thing is all insurance companies and advice generally is never to admit liability - always confused me that, if it is quite clearly your fault :confused:

Yep we tell people never to admit liability in the event of an accident. It might not be your fault.

Typical example, someone i know recently had a car accident, both vehicles going down a country lane so both in the middle of the road. They collide, guy i know gets out and sees that the other party is female and has a young baby in the back of the car. Says "oh my god i`m sorry", calls insurance co and says he said sorry, phone bod puts it down as his fault. I get documents from him call his and the third party and get the claim down as a 50/50.

Had he not admitted fault at the scene it would have been a lot easier. He didn`t know what he was doing, as it was we had to go through a claims inspector interview before his own insurance co changed their mind. And all this from a very large household name insurer !!

To be honest yes getting someone to write those details can help, however the person who wrote them can always say they were under duress and it gets discounted, and it`s not the nicest thing to ask someone to do. The very best thing you can get, if availiable, is independent witnesses.

As for the actual question can it void your policy, it is a usually a general term and condition of your policy not to admit liability, so yes technically i suppose they could but it would be on breach of contract and not duty of disclosure. Never heard it happen and the only way i think it could is if you said you were at fault when clearly you were not and the only way the insurance company had of protecting themselves was to use the clause.

Thanks for the reply. I belive theres voice recording and photographs as the the lady in question ran into the back of him whilst waiting to enter a roundabout.The goes to the garage for a quote today.

mate has been here before! it went to court as well, she run into the side of his car when he was reversing into the parking space, she got out said sorry it was her fualt! few weeks down the line, she's making out he reversed into her!

(she hit his door)
