I was involed in an acidient with another driver on a roundabout. The insurance company has offered the default 50/50 settlement.

Her story and my story are different meaning one of us is either mistaken or lieing.

Both parties have filled there stories with the comapnies. I will show them here and hope that with the standard good qulaity advice i may prove my case.

Appologies for the length of this but please read.

What happened?



1.) I am going straight over roundabout.

2.) Other driver has also planned to go straight over the roundabout travelling in the opposite direction.

3.) Other driver miss’s her exit and carries on around the roundabout with no indicator.

4.) Momentarily mistaking my exit for hers she then turns hard right to stay on the roundabout.

5.) I intending to leave take avoiding action to try and avoid a collision. I also turn hard right.

6.) As she moves onto the right side of the roundabout lane she hit my front wing/wheel with her rear quarters.



First actions: Move my vehicle to safety to un-block the roundabout. I then looked at my vehicle to check for any obvious hazards. I then got the other driver to move her car to safety. As I did I observed no street furniture was hit and no debris was on dual carriageway. I inspected both vehicles to get an idea of what action was to be needed for recovery and to check for any loose or missing parts. Mine was damaged badly and didn’t drive well so I didn’t move it far without inspecting it first.



A quick Inspection: My inspection revealed a bent wing, track rod, suspension moved, paint work damage to door and bumper and a scratched indicator.



Her car had rear quarter panel damage, a lip of which has bent over the rear door and an impact mark on wheel trim.



Street furniture: None. Impact between two cars.



Injuries: None. Children were fine, no injuries observed, they were as cheerful as could be expected, the driver seemed a little shocked, I was quite shook up and took time to calm down during which time I spoke to my friend for advice. We discussed what had had happened.



Discussion: She took time to realise what went wrong and was quite apologetic about the whole matter. We spoke about how the accident happened. She told me she was travelling down to her father’s house. She seemed very unsure of the roads and her little son had been helping his mum map read. Not knowing the roundabout she came round on the outside with no indicators because when you go straight ahead no indicators are needed except for leaving. The sign on her exit was missing. This confused the driver and so the driver continued around the outside of the roundabout. Seeing my exit with she starts to go off. She then realises she is going back the other way. She moves over to the right very fast to stay on the roundabout and then starts to move to the right lane past the middle mark on the roundabout. We then walked up to the roundabout so that we could see it and then talk and point to show car positions. I then pointed and showed her where I was and how believing her to be coming off, as her road position and lack of indicators suggested. Then in horror had seen her turn direct into my path I had steered right very fast and had changed direction almost 90 degrees to the right which narrowly avoided a very nasty collision where I would of T boned her. As it was I had turned right as tight as I possibly could and that had she seen me and not moved to the right side of the roundabout lane she would of have avoided me.



Vehicle Activity: Vehicles were moved further down road on safety issues and I eventually opted for the grass on safety grounds.



Attitude: All persons behaved politely and had no arguments over right or wrong. Details of what happened were discussed.

If you have a fender bender, always have whiplash, it means the police have to attend and deal. Their recommendations as to who was to blame are usually followed by the insurance companies.
You da not have to accept the findings of your insurance company, but it takes a strong will to take them on. Probably best answered by any specialist motoring solicitors.:keystone:
