It's part of the UK, so why is it subject to (albeit slightly) different laws?

It's a historic thing, Scotlands laws are based on French law.

As stated Scotland has always had its own legal system.

That said the Road Traffic Law is the same and certain other statues have Scottish versions when the government (UK) wish to bring in a UK wide law.

It is fair to say both systems have their pros and cons but Feds who have transferred to Scotland tend to find Scots Law easier to learn as it is largely based on Common Law. A guy I joined with transferred down south and found it quite difficult to get his head round some of the PACE laws.

Was Braveheart not about Austrailians in Ireland??

Because we were always picking fights with England, we often had closer relationships with out European neighbours such as the Netherlands and France. Our legal syatem probably developed at a time when we were more friendly with the dutch than the english. The french have a civil law system, and although I did law at uni, I can't remember why we ended up with a common law system.

The ultimate appeal in scots civil law is to the House of Lords, but for criminal law it goes no further than scotland. Unsure of the status of european law nowadays.

Certain aspects of law can now be legislated on by the scottish parliament, but IIRC the important ones were sensibly reserved by Westminster ;)

We also have our own education system - again, probably has pros and cons vs the english one.
