Two different offences which until today after reading a Dft Leaflet that stated i could be prosecuted for 'Drink Driving' even if my breath alchohol limit was less than 35 Micrograms i hadn't realised there was a difference although i do now understand the difference.
How common are section 4 offences and how do the penalties for section 4 offences compare to Section 5 offences?

Hi guys, been a while since I've posted on here

My wife was hit by a courier driver a few weeks back, self employed type for DPD. Was 100% his fault, he drove into the side of her as he wasn't looking.

Currently going through the motions of insurance, his insurers are coming out today to view the damage and provide an estimate etc

However, his insurance company have said that there's a problem with his idemnity, but wouldn't say anything else about it.

I wrote report for his insurers with photo's of the accident, google earth pics etc etc, one of the pictures showing his DPD high vis vest.

Could idemnity problems perhaps suggest he wasn't correctly insured or hasn't declared a type of business use etc?

He has still failed to contact his insurance company even many weeks later.

Your thoughts appreciated.

Hi, my friends son is up on a dangerous driving charge and shes beside herself (fueled by gossip off the internet) that hes going to prison so thought i would do some research.

So Boy overtook a car who had a video camera recording in the front of it. The driver contacted the police who told him they couldn't do anything about it other than pull the boy in for a chat so the driver decided he would post the video on a social network site(where i got this info from). According to questions asked about the video the driver said that he bought a cheap car video camera off ebay to catch this kind of thing and he took the memory card out of the camera put it on his computer and then took the police a copy.
Boy was asked to attend the local police station for a chat 13 days later regarding an overtaking incideint which he did. Boy denied it as he couldn't recall it and then the policeman said that he had video evidence. Boy then said he thought he needed a solicitor but the policeman said that there was only 3 more questions to ask so he answered them. Boy has said he got himself all in a fluster and can't really remember what he said but he has said that he wasn't speeding but on the video it looks like he also comes close to a parked car in a layby on the other side of the road. This is my opinion(which counts for nothing) but i think its the angle of the camera as its 2 lane and the cars the size of a mini. Boys friend who was in with him also says he was nowhere near the car(to his mother not police).
Boy was then cautioned with careless and dangerous driving.
Boy did contact solicitor next day as the interview was quite late the previous evening who said he would probably receive a summons and to go back when he did which he will this week as he received the summons a few days ago.
So i'm just trying to find out what the likely outcome will be, i have tried to find out but i haven't come across any cases using public video evidence(might just be looking in the right place)
So can the video evidence be used? i'm intreaged(think thats the right word) to know as if we all went around videoing each other and it was used in court then god it'd be chaos, I encounter bad driving many times on a daily basis! I mean whats to say its taken on that date, it hasn't been tampered with as its not the original its a copy. Surely if it was to be used in evidence it shouldn't still be on the social network site.
So if that couldn't be used then can his statement seeing as it was based on the video evidence?
As i said i'm just trying to find out what the outcome might be as his mother is beside herself, mind you depending on what i find out i might not tell her anyway!

I imagine my 'customers'..or should I say, 'products' are either going 'whooptidoo', another day off in York'....or are cursing as they have to spend yet more days in the hell-hole by which my-place-of-work is viewed?

Bit of seriously bad timing on the Govt's part, allowing the fact that they've finally done a [yet another] U-turn over the new VSTOL fighter aircraft for the Navy....and agreed with the old Labour Govt's conclusions of years ago......all at incredible expense?

Expense, not from the increase or not of actual production costs...although they are bad enough......but the costs of actually arriving at a full circle conclusion in the first place.

Millions of pounds spent engaging experts in the industry to come to a conclusion reached years ago.......most likely without using the in-house expertise within the MoD...when, If they have only come to my place-of-work, we could have given them the same answers for the price of 200 bacon butties and thirty bob in the Xmas beer fund!

Hello all - joined this forum and wondering if you people can help (possibly the police)

Police came to my house to arrest an individual and I was upstairs - when I came down the police office a woman officer started pushing me to stay back. she asked me to calm down when I hadn't even said a word! She was in my face and asked her that its my house and can move wherever I like and told her I didn't agree to her attitude. My friend suggested I make a video, she must have overheard and while I got my phone out she said firstly asked me to delete the video - i told her there was no video. she then took my phone and her colleague didn't know about the phone and she took my phone. 3 weeks on and not received the phone back.
I went to the nick and spoke to her sergeant - he was as worse as her! He wasn't helpful just saying the hate crime unit or something along the lines - that will have to speak to them now. How can I go about getting my phone back as I have left messages to her and even wrote a formal letter. I use my phone for my business and losing out on a lot of business.

Just after a bit of advice, i received a parking ticket yesterday the parking contravention states: PARKED IN A RESTRICTED STREET DURING PRESCRIBED HOURS. Now i used my grandads disabled parking badge as he was in the vehicle as we were visiting my nan in hospital. All the other cars in street had the disabled badge and the parking disc displayed so i did exactly the same, came back out and ticket on windscreen and the disc was on the floor of the car and not the dash where i left it with the badge, Now i contacted the council and they wasnt sure what the problem could of been but said if the disc had fell off the dash then that wasnt their problem, he did ask was i parked half on kerb as could of been that but i said no others were but i wasnt. This is the first time ive used this badge and today took my grandad back the hospital but decided to just find a car park and pay as not sure of the allowances with disabled badge now. How do i go about appealing as from the telephone call i got the impression the guy was saying your wasting your time it wont be overturned. ANY ADVICE PLEASE

Evening!

I was pulled over (yes, driving, but this isn't motoring law related, I promise I'm posting this in the right place!) a couple of nights ago.

Very polite officer went through the usual checks, insurance, tax, lights and tyres, etc, before calling in a person check.

Over the radio, I heard "Alexander <Lastname> does not have any current convictions or warrants, but does appear on SCRO, possibly a childhood conviction."

This puzzled me as the worst thing I've ever "done" was recieve a 21-day VDRS, which I returned the following day, correctly stamped and signed, to the issuing station!

Never had a conviction, never even been interviewed as a suspect, should have a completely clear criminal record.

Can anyone tell me what would cause my name to appear on SCRO, or how I would go about finding out why I appear on SCRO?

im 18 years old and since october i have been struggling to cope with a guy who has been stalking me. it all started because we met up. i knew him through a friend but had never spent any time properly with him. we met up and there was something very strange about him. i told him i didnt want to meet up with him again. ever since then he would follow me. he knows my routine better than i do. he would come into work looking for me. wait outside work for me. previous to this i have recieved threatening text messages saying that he is going to 'kill me, follow my parents and kill them, burn my house down.

after recieving these a phoned the police. after a couple of months they eventually put a harrassment order in place but he continued to follow me. he even knew which bus i would be on and would wait for me at the bus stop. after this continued he was arrested. he was interviewed and found guilty of harrassment. he was taken to court. he was only fined £60 for 6months. and given a restraining order. since then he has been following me again.

i have called the police and they have just given him a warning. EVEN THO he has broken his harrassment order. this is very stressful for me to have to deal with. it effects my everyday life in many major ways. i have a feeling that this is going to carry on. the police have said they cant do too much until he does something to me. no im not going to sit back and wait to be assulted before something gets done.

my question is.. what else can i do???? this is scary for me.. and after everything he is still carrying on... will he stop. the police even said there is something not right with him... it makes me extremely nervous. please help
