Hello all

This is my first post which I'd hope I'd never have to make

In March this year myself and another driver pulled in behind some parked cars on a residential street to allow an oncoming vehicle to pass. As it grew closer I realised it was a fully laden car transporter carrying 12/14 cars.

The guy in front was lucky as it missed the side of his car by less that half a foot, we're talking cm here. I wasn't so lucky, his rear trailer section wheels and mudguard took out the rear side of my car.

He didn't stop and I gave chase but he ignored me so I went back and the guy in front had parked up. He didn't see him strike me but has since written a statement to my insurance stating we were stationary, the transporter was traveling far to quickly for the conditions and road and that he gave neither of us anytime (himself included) to re-assess whether it was safe for him to proceed or if we needed to move our vehicles onto the pavement, or reverse etc

I attended the local Police station who took my statement and a breath reading and then two officers managed to trace the driver to the local transport yard. The driver denied having any knowledge of hitting vehicles but accepted he was on the road at that time and gave a statement and also had a breath sample taken.

Since all this he is denying having any knowledge of this incident at all, as in nothing. Denying anyone told him about it. My insurance company have obtained the Police report but it does not contain statements only the vehicles and drivers involved plus witness. They, my insurance, are stating that the Police could have obtained this information without contacting the driver or his company (both of which the Police did do)

I have argued that as it was a fleet vehicle the only way they could know who was driving and gain his address was to speak to the company and/or driver. They are disputing this, and this is MY insurance company!! The officer who attended and his partner have both confirmed this is the case, they only knew who the vehicle was registered to, not who was driving it until they made contact with the vehicle owner and driver.

I am at my wits end as it would appear this driver can deny everything and despite the Police taking a statement, a breath sample, speaking to his office at the time and get away scot free.

Can anyone offer some advice as to how I can move this forward?

I have been asked a question that I do not know the answer, and seek guidance from the gathered amongst us who might.!

Mr X was declared Bankrupt and all creditors were so notified, the courts gave their order and after 3 years had gone by, the bankrupt notice expired and Mr X could once again go about normal buisness.

All of a sudden a high street branch contacted Mr X and said you did owe us £1000.00 but we will accept £300 in full and final payment for this amount.

Mr X firmly believed that any debts covered by being made Bankrupt would be no longer valid and the companies or banks in this case could not continue to seek repayment in full or part of any monies owed.

Is this correct or can a bank now try to get the money repaid in full or in part ?

Your guidance in this matter is appreciated

Hi all

I was involved in an RTA a few months ago and have been summoned for a driving without due care. I was changing the radio so momentarily distracted, although this was clearly all it took for the accident to happen - hard lesson learned!

I admitted immediately what had happened and then pleaded guilty by post but am now required to attend in person as they are considering a ban. The injuries of both parties were significant in this accident, does this increase my chances of receiving a ban? i.e. the more serious the accident the more likely a ban will be imposed, regardless of the action that led to the accident? I am not disputing that I should be punished, just trying to prepare myself for the likely outcome.

Thank You

Hi guys

Following an allegation of criminal damage (not pursued by the boys in blue after an initial investigation - they said she was being 'vindictive'!!) I was issued with a harassment notice in January 2009. The terms of which included that I shouldn't go to where my ex-wife might frequent (no problem at all!!) and if I wanted to contact my son I should do so through a solicitor. It's my son's 15th birthday coming up and I'd like to send him a birthday card, but don't want to end up in the clink for doing so, nor do I want to spend ££££ to send a card via a solicitor!!

Any ideas?

cheers in advance

Looking for practical advice on reclaiming expenses.

On Thursday the 8th July 2010 at 10:48 am. I was stopped by an unmarked police car and was informed that I was driving without Insurance.

I protested my innocence but was told that I had probably entered one digit wrong when taking out the insurance and so it did not show up on the PNC or MIB, I was asked who I was insured with but as I had taken it out on the internet I explained that I could not remeber. I was then asked to phone my wife to retrieve the insurance companies phone number, I was happy to do this and explained to the police officer that she was not at home and it would take anything between 20 mins to 1/2 an hour, no he could not wait that long.

To cut a long story short my van was seized etc.

My wife picked me up as soon as she could and ran me home, I then rang my insurance company and it was confirmed that my policy was in force from the 5th May 2010 and expired on the 4th May 2011, I was also informed that an official investigation would be carried out.

I took my documents to the police station on Friday and was assured that the court case would be stopped apologies were made but I was still required to pay the £170 release fee.

Now I fully intend to persue this further as far as claiming all my out of pocket expenses but wonder who I should persue.

I feel that the police have chosen to rely entirely o0n the PNC/MIB database knowing full well that this is not 100% accurate and so should be willing to compensate when they get it wrong, and furthermore it is the police that seized my vehicle and not the insurance company.

I was also informed by the officer that stopped me that a certicate of motor insurance was not acceptable proof (and this will have been recorded) as premiums could have been stopped or the certificate forged.

Any one able to advise?

I am quite willing to publish all the facts - on this forum if I think it would help.

Oxfordshire's speed cameras face cutback

Dozens of speed cameras could be switched off in Oxfordshire as a cost-cutting measure.
County councillors will consider withdrawing money to run the cameras - part of an £11m savings plan.
A spokesman said the camera boxes are likely to stay in place in the short term, even if they are not able to record speeding drivers.
There are 72 fixed-speed cameras in the county, along with seven cameras at traffic lights and 14 mobile vans.
The cameras are run by the Thames Valley Safer Roads Partnership, which could lose its £600,000 county council grant.
The partnership said the move would "drastically reduce" the level of enforcement on the county's roads.
Spokesman Dan Campsall said: "Discussions are ongoing and a final agreement on the assessment of the service provision has yet to be reached. But in the light of a 70% cut to funding it would drastically reduce the level of enforcement."
'Cameras disappearing' Keith Mitchell, leader of Oxfordshire County Council, said the cameras would not be immediately removed if the cuts are confirmed.
"The presence of the yellow box is a deterrent in itself.
"Over the longer term, I guess those cameras will be disappearing and in time the yellow boxes will have to come down from the point of view of safety," he said.
The proposal is part of £11m-worth of cuts the council has to make from this year's budget as a result of the government's reduction in public spending.
Other proposed cuts include a reduction in money for youth centres in rural areas, careers services and road improvements.
Councillors will decide whether to go ahead with the cuts at a special budget meeting on 27 July.

In the recent case of Raoul Moat and some previous high profile cases involving crime.. Shy TV News have been dominant. is this the way we want these incidents to be policed.. Camera's were in the front line all the time. Following Police convoys, watching events as they happen from helicopters and interviewing so called experts and giving info away that could be used by the culprits.. In the Moat case, so called experts in field training and stuff... asking what they would do if they were him and what he should be doing to avoid capture... all similar interviews with Phyc doctors and professors and retired police men... all giving opinions and stuff and tactics... all of which were broadcast by Sky news so the nasty villian can watch learn and be that one step ahead of the police...
he can see convoys on the move and where they are going to, he can see where they are searching, he can see what tactics are being considered in tracing him....
Is SKY News therefore Assisting him ??????
and in Media briefings are the police giving far to much away... and are the media asking the most stupid and also most in depth questions that we should not be answering?

Do we really want news teams in the way of police investigations....? are they a manace or a help

my daughter has been nagging me to get a dog, so i have been searching local free adds.
i came accross a website called oodle which had lots of dog adds but one or two smelt a little fishy.
i noticed that the same advertiser was seemingly selling or giving away dogs in many different areas of the country, i had simply ignored the adds but it has been bugging me as to what these individuals are up to.
i reported the adds through the website to no effect so i responded to one of the adds and recieved the following response;
Hello Dear,
My time table was change so right now i work from Monday to Saturday and my only resting day is Sunday which i am quite busy with church Activities. So there is no one home to carter for them so for that reason i really love some one to take good care over this little puppies, so that's why i want them to go to any caring and loving home that will care and carter for them. And they are so sensitive and possesses for following:
If this is ok by you, i will immediately need the following details in order to drop off
the puppies as soon as possible at the delivery agency so that delivery can be done to your home soonest.
______________
-Names in full
-Home address
My prayer is that you love and care for these puppies just as i did and i will be always great-full to you if you should 0703xxxxxx. Do let me know if all is fine.
best regard

My uncle who has not driven for just over a year has decided he wants to drive again. However, upon looking at his photocard, he found that the photocard has expired a couple of weeks after he gave up driving (expired for a year).

He has not been able to find any solid information on helping him renew his photocard and DVLA has only responded that if he sends his current photocard in for renewal, it will be returned as it has gone beyond the 56 day expiry period for renewal. They have not provided him with any information on how to renew a photocard that has expired for a year either.

He is concerned about being fined for not renewing and cannot drive until the photocard is renewed. What would be the best course of action? Thanks!
